Nyanya bombing: DSS,Police fight in court over Ogwuche’s trial
DSS AND POLICE FIGHT IN COURT OVER ARRAIGNMENT OF IYANYA BOMBING MASTERMIND, OGWUCHE.

The planned arraignment of  the alleged mastermind of the April 14, bomb blast that killed over 75 persons at a motor park in Nyanya Abuja, Aminu Ogwuche, was stalled yesterday owing to bickering between the Department of State Service, DSS, and the Nigerian Police Force, over which of them should be allowed to conduct the trial.
Sequel to a heated argument that ensued between lawyers from the two security agencies yesterday, the Judge in charge of the case, Justice Ademola Adeniyi, said he was left with no option than to adjourn the matter till November 10, to enable Federal Government to put its house in order. It will be recalled that  Federal Government had in its bid to expedite the process of extraditing the accused person from Sudan where he escaped to shortly after the terrorist attack, entered a three-count criminal charge before the High Court.
The charge which was endorsed by the Inspector General of Police, was still pending before the High Court when the accused person was successfully returned to the country with the help of the Interpol in Sudan.

Meanwhile, upon taking custody of the accused person, the DSS, promptly approached the high court for an order permitting it to retain him in detention until the conclusion of investigations into the matter.

FAYEMI SAYS FAYOSE IS BEHIND THE FRACAS IN EKITI

The Ekiti State Governor, Kayode Fayemi, has accused the in-coming governor, Ayo Fayose, police and other security agencies of fuelling crisis in the state after political thugs descended on two state courts in a week attacking staff and judges.
The government ordered the closure of all courts Thursday, following a second attack. A curfew was imposed by the governor on Friday.
In a state-wide broadcast, Mr. Fayemi pointedly accused Mr. Fayose of hiring the thugs who broke into the courts and unleashed violence on judges and judicial officers in Ado Ekiti.
“I am advised incontrovertibly that thugs acting on the command of Mr. Ayo Fayose, who was also present to lend his clout to the travesty, brazenly assaulted a senior judge and urged his thugs to beat him up and tear his clothes,” said Mr. Fayemi.
He said the brigands, whose action exceeded the limits of acceptable behaviour, carried out their scandalous attacks in the “full glare of law enforcement agents”.
Mr. Fayemi said when the crisis started, he was in touch with the heads of security agencies in the state and at the federal level, urging them to act fast and decisively to preserve public law and order.
Unfortunately, he said, the response of the security agencies was slow and inadequate, thereby leading to the escalation of violence in the state.
The governor said since an earlier assault on the court did not meet strong response from appropriate security agencies, the miscreants were emboldened to unleash terror during the sitting of the state Election Petition Tribunal.
He said, “Since the beginning of this development on Monday, which is unprecedented in the recent history of our state, I have been in touch with the heads of all security agencies at the state and Federal levels, urging them to act quickly and firmly in the interest of public law and order.
“It is worrisome that the slow and inadequate response has occasioned the avoidable escalation of violence in our dear state.
He urged all indigenes to work together to ensure that the state comes out stronger from the delicate situation.
“During periods of transition, vital partners in progress adopt a cautious posture, watching for the slightest portents of the possible discontinuity of the regime of peace and tranquility, amongst other factors that have made our state conducive for investors and development partners.
“We must not disrupt our very bright prospects for sustained development in our state. Considering the cases that have triggered the recent spate of violence are politically related, the political elite in our state from all disparate quarters must exercise caution.
“We must rescue our state from the precarious slippery slope that some have desperately pushed us to. We should not imperil the very people we seek to serve by resorting to violence and brigandage. One does not burn down his homestead to establish his claim of ownership or leadership,” the governor advised.
To forestall further attacks on the courts, Mr. Fayemi said he has directed the attorney general of the state to issue a legal advisory to the chief judge and all parties to existing cases in the high court and Election Tribunal to seek alternative venues for hearing such cases outside Ekiti State.
He said the state can no longer afford to witness the bizarre sight of beating up of judicial officers and wanton intimidation of lawyers and court personnel.
Since security operatives seemed to have brought the situation under control, Mr. Fayemi called on them not to relent in performing their constitutional role of protecting lives and property in the state.
Violence broke out in Ado Ekiti on Monday when thugs believed to be sympathetic to the PDP stormed a court and attacked the judge, O. Ogunyemi, who was hearing a case concerning the eligibility of Governor-elect, Ayodele Fayose, for the recent governorship election in the state.
The court sitting was disrupted; litigants were beaten while the judge was ferried to safety by police after he was threatened by the militants, the state chief judge explained on Thursday.
On Thursday, another set of political thugs backing Mr. Fayose descended on another court, attacking a judge and other staff.
The assailants attacked Justice John Adeyeye, beating him up and ripping his clothes for being allegedly rude to Mr. Fayose.
The pandemonium that ensued scuttled the Ekiti State Governorship Election petition Tribunal sitting billed for the day at the High court, Ado-Ekiti, as judicial workers abandoned their duty post and ran for safety, witnesses and the state judiciary authority said.

In response to the attacks, the state Chief Judge, A. Daramola, ordered all state courts to remain closed until adequate security measures are in place, according to a statement by Chief Registrar Obafemi Fasanmi.

MINISTER ABBA MORO IN FRESH SCANDAL!DEFRAUDS NIGERIANS OF MILLIONS.

Controversial Minister of Interior, Abba Moro, has devised a fresh scheme to fleece Nigerians. Using the increase in the new fees charged for the Nigerian passport, he has formulated a new policy that would effectively extort billions from unsuspecting Nigerians every month.
Beginning in August, the minster illegally contracted a freight forwarding and courier company, Greater Washington Limited, to deliver passports to applicants at the cost of N2,000.
The fee has been built into the new fee of N19,550 charged for the Nigerian passport and every applicant is forced to pay the money whether she/he wants the service or not.
The new payment regime for the Nigerian passport commenced on August 1, when the federal government also rolled out the new 64-page passport for frequent travellers. Where the 32-page passport used to cost N8,750 for all Nigerians under the old regime, with the new rate, applicants aged 1 to 18 and 60 and above would now be the only ones allowed to pay the old rate of N8,750. All other applicants (aged 18 to 60) would pay N15,000.
This was announced by the Minister of Interior at the launch of the 64-page passport by President Goodluck Jonathan at the Presidential Villa on July 29. The minister said further that the 64-page passport would cost N20,000 while change of data for reasons other than marriage or divorce would attract a N30,000 processing fee.
What Moro failed to tell his audience, including President Jonathan, is that Nigerians would now be forced to pay N2,000 to have their passports delivered to their homes.
Our investigations indicate that the total amount paid for the passport is N15,600, including bank charges.
An applicant is expected to indicate if he prefers to pick up his/her passport personally or would like it delivered. However, whatever option is chosen, the N2,000 for delivery has to be paid. Many applicants who say they would pick up their passports because they do not want any delay are still being made to pay the N2,000.
By the new system, after filling the application forms and making necessary payments, applicants are expected to go to the Greater Washington office at the passport office where the application is made to submit contact address for the delivery of their passports.
However, there are many things wrong with the entire arrangement of having a private company deliver passports to citizens.
First, from icirnigeria.org investigations, the minister did not go through due process in awarding the contract to deliver passports to applicants to Greater Washington as there was no advertisement or bidding process. The company was exclusively the minister’s choice.
Also, what is now being made to look like a government policy did not arise as a result of a need because Nigerians did not demand that their passports be delivered to them in their homes. Sources in NIS passport offices said that there were never any complaints from applicants about personally picking up their passports.
Besides, if the new policy were to be given any consideration at all, then the Immigration Service would have been best placed to perform that task.
First, all Immigration passport offices across the country have both issuance and collection centres. More important, the NIS also has an office in all the local governments of the country and is already equipped to render the service. What would be required would be to strengthen its capacity to enable it to deliver.
This is even truer as investigations revealed that Greater Washington only has three members of staff and two motorcycles attached to each passport office in the state.
This is inadequate to service even the state capital. For instance, Kano State, with its huge land mass and population and Lagos, which has a vast population, will stretch the inadequate arrangements to the limits.
There is also the issue of applicants who apply for passports in places where they are not resident. For example, in the case of an applicant who lives in Kano but applies for a passport while on holiday in Calabar, Cross Rivers State, would the delivery company deliver his passport to him in Kano?
Another problem with the new system is that although it looks like Nigerians are given an option of choosing whether they would collect their passports personally or have them delivered, the reality is that whatever option applicant choses, he/she still pays the N2,000.
Our investigation reveals that at least in Abuja and Lagos where our reporters monitored the passport collection process, most people still go to physically collect their passports, meaning that they had paid Greater Washington for services not rendered.
An equally important point is that just in order to ensure that a private company benefits from passport issuance, the minister, and the federal government by implication, has sacrificed all the gains of the last 10 years to deliver a passport within 24 to 48 hours after application.
With the new system, the time an applicant gets his/her passport depends on how long it takes the delivery company to locate his/her address.
However, for some officials of the Immigration Service who spoke to the iicirnigeria.org on the condition of anonymity, the most worrying aspect of the whole scheme is that a security document which contains the bio data of Nigerians is being handed over to a private company.
That could have grave security implications, they observed.
The officers point out that the passport is a security document and the most valid and authentic evidence of a person’s citizenship. It contains a microchip which holds all the biometric data of the passport holder as well as names and addresses of his/her guarantor.
In the hands of a private company whose staff might have ulterior or criminal motives, this could have grave consequences as such a person can access all the information about the passport owner by slotting it into a machine reader.

“It is unbelievable that the Nigerian government can hand over something as sensitive as the biometric data of its citizens to private individuals. No country in the world that I know has ever done that because it could have grave security implications. For me I think it is wrong for a private company to handle such sensitive security document,” said one Immigration officer.

TB Joshua

HOW OTHER PASTORS SEE PROPHET T.B JOSHUA...

Prophet TB Joshua of Synagogue Church of All Nations is no stranger to controversies and condemnations. Since his emergence as a man of God to whom many run for deliverance, salvation and miracles, the supposed man of God has had to fight off other men of God who see him as nothing but fake.
Perhaps, the most antagonistic among them all is Reverend Chris Okotie of the Household of God who once described the Prophet as the vicar of the devil on earth. Okotie has no mixed feelings about T.B Joshua. To him, the so-called man of God at Synagogue Church of All Nations shouldn’t be associated with because, according to him, he is in partnership with Satan to subjugate the church to the will of the devil.Okotie’s aversion to everything T.B Joshua stands for became more evident sometime ago when a video showed T.B Joshua and Pastor Chris Oyakhilome purportedly praying for a man on wheelchair.
Pastor Chris Okotie made a number of public comments to Nigerian newspapers and other media sources expressing displeasure that the respected Pastor Chris Oyakilhome started fraternising with TB Joshua.
In one of his media comments, Okotie alleged that T.B. Joshua was a practitioner of an occult science called Docetic Gnosticism and Cerinthian heresy. Docetic Gnosticism, according to Wikipaedia was an ancient Greek spiritual belief system during A.D. 70 through A.D. 100.This particular group asserted that Jesus Christ did not rise physically from the grave as foretold by the Old Testament prophets, eye-witnessed by the apostles and recorded in scripture. This teaching is the biblical definition of false prophecy – the teaching that Christ did not rise physically from the grave.
Cerinthus was a Greek heretic (A.D. 100) who denied the divinity of Jesus Christ. According to Cerinthus, Jesus Christ was not born of a virgin as scripture plainly declares. Cerinthus also believed that during the future millennial reign of Christ inhabitants of the earth would be in bondage to certain lust.
Okotie has also ascribed the acclaimed healing power of TB Joshua to the practice of an ancient Asian yoga-like sorcery called Shamanism, a practice, according to Wikipeadia, that involves a practitioner reaching altered states of consciousness in order to encounter and interact with the spirit world and channel these transcendental energies into this world. A shaman is a person regarded as having access to, and influence in, the world of benevolent and malevolent spirits, who typically enters into a trance state during a ritual, and practices divination and healing.
Evidences abound that worshipers at Synagogue revere and and adulate the name of T.B Joshua by calling him ‘Emmanuel’ (God with us). To this, Chris Okotie stated emphatically: “‘He (T.B Joshua) has three symbols of mysticism. The first is called “The Head of Jesus Christ” or “Christ”. This is a reference to the source of his power. That power is invoked or acknowledged by the word, “Emmanuel.” When “Emmanuel” is chanted, it energizes’ the power. The scriptures say that the head of Christ is God. So when Joshua ‘refers to that head, he is speaking of himself as God Incarnate.’
At the height of the Joshua-Okotie-Oyakhilome imbroglio, other Pentecostal pastors warned T.B Joshua not to parade himself as a Pentecostal preacher.
“He is an occultist,” says Anselm Modubuku, pastor of the Revival Assembly Church in Lagos. “Joshua claims he was born again in his mother’s womb. It is tragic that Spirit-filled people are led astray by him.”
“It is puzzling why Americans are drawn to him,” said Ayo Oritsejafor, pastor of Word of Life Bible Church in Warri and now President of Christian Association of God, CAN. “Where and when did he get saved? Who is his pastor? That is what I would like to know.”
The Pentecostal Fellowship of Nigeria, headed by Bishop Mike Okonkwo, denounced Joshua as an imposter in a statement. It said the group had for years warned of “the dangers of infiltrators who have modernized cultism by injecting the name of Jesus Christ into their largely unbiblical practices. It is necessary that we reiterate this position that the Synagogue (of All Nations) falls into this category.”

The military insists the real Shekau was killed long ago

We have killed Boko Haram leader, Abubakar Shekau — Nigerian Military

The Nigerian military on Wednesday issued an official confirmation to reports that Abubakar Shekau, the eccentric leader of Boko Haram, whose death the military has claimed repeatedly only to turn out untrue, has been killed by security forces.
Officially, the military insists the real Mr. Shekau was killed by soldiers more than a year ago, but that his character had been assumed by another leader of the deadly group.
The impersonator is the man who appeared in several Boko Haram propaganda videos, claiming he is Mr. Shekau, the military said.
It was that new face of Mr. Shekau that was killed in a fierce clash with the military last week in Konduga, near Maiduguri, Borno State, defence spokesperson, Chris Olukolade, said Wednesday.
That man, Mr. Olukolade said, was Mohammed Bashir, known also with several aliases.
The statement Wednesday was the first official confirmation of the death of Mr. Shekau since news broke last week he had been killed in a confrontation as militants moved to attack Maiduguri.
While the Nigerian military, unofficially, laid claims to the killing of Mr. Shekau, its Cameroonian counterpart also claimed credit for it saying Mr. Shekau was killed at Gamboru near the border.
The Nigerian military rejects that claim.
Mr. Olukolade said the alleged Shekau’s double was targeted amongst other leaders of the group in Konduga when the military’s land and air forces engaged a convoy of combat vehicles conveying several militants.
“Several of the terrorists, including some of their commanders, lost their lives in the encounters which lasted an average of about 5 hours each,” the defence spokesperson said.
“The troops captured some of the terrorists and their equipment. In the course of those encounters, one Mohammed Bashir who has been acting or posing on videos as the deceased Abubakar Shekau, the eccentric character known as leader of the group died.
Mr. Olukolade said after the clash, the identity of Mr. Bashir was confirmed by the locals in Konduga. Mr. Bashir’s other names he said included Abubakar Shekau, alias Abacha Abdullahi Geidam alias Damasack.
“Since the name Shekau has become a brand name for the terrorists’ leader, the Nigerian military remains resolute to serve justice to anyone who assumes that designation or title as well as all terrorists that seek to violate the freedom and territory of Nigeria,” the military said.
Mr. Olukolade said 135 other terrorists on Tuesday evening surrendered along with equipment to troops around Biu Local Government Area.
A group of 88 submitted themselves at Mairiga/Bun – Yadi while another group of 45 terrorists were taken in around Mubi – Michika. They are all being interrogated and processed in conformity with the dictates of standard best practices.

Femi Falana

FALANA WANTS POLICE CHIEF TO ARREST THE THUGS THAT SACKED EKITI COURT.

Senior lawyer and human rights campaigner, Femi Falana, late Friday in Lagos called on the Acting Inspector-General of Police, Mr. Suleiman Abbah, to “arrested and prosecuted without any delay” those who invaded an Ado Ekiti High Court, beat up a Judge, and violated the Court of Justice.
Mr. Falana put the blame on the “Ekiti state governor-elect, Mr. Ayo Fayose “ whom he said “has justified the shameful attack on the rule of law in Ekiti State by saying that his election cannot be challenged in court.”
“This is a reminder of the Idi Amin era in Uganda when judges were killed while discharging judicial functions” Mr. Falana urging that Mr. Fayose and his thugs should not be allowed to kill judges and lawyers before calling him to order.”
His full statement reads:
“In my reaction to the outcome of the Ekiti state governorship election held on June 21, 2014 , I expressed the view that the Ekiti people had gone back to Egypt. The mayhem unleashed on a high court judge, lawyers and litigants in the precint aaof the Ekiti State High Court sitting at Ado Ekiti on Monday, September, 23, 2014 by a gang of hired hoodlums has confirmed that the Ekiti people have fully returned to the wilderness.
“As the thugs were not brought to book they regrouped this morning and launched another attack on the High Court. In the process Justice Isaac Adeyeye was beaten up while the car of Mr. Rotimi Akeredolu, a former President of the Nigerian Bar Association was destroyed. Other judges and lawyers ran for dear lives.
“Thus, by desecrating the temple of Justice with the connivance of the Police the armed lumpen elements left no one in doubt that they have the full backing of the ruling party in executing the premeditated onslaught on the judiciary.
“So far, those who perpetrated the barbaric attack and their sponsors  have their admitted ignoble role through public statements issued by them. The Ekiti state governor-elect, Mr. Ayo Fayose has justified the shameful attack on the rule of law in Ekiti State by saying that his election cannot be challenged in court. This is a reminder of the Idi Amin era in Uganda when judges were killed while discharging judicial functions.  Mr. Fayose and his thugs should not be allowed to kill judges and lawyers before calling him to order.
“Since the Ekiti State police command is completely compromised the Acting Inspector-General of Police, Mr. Suleiman Abbah is called upon to ensure that all the assailants are arrested and prosecuted without any delay.
“Any attempt to cover up the brazen contempt of court should be resisted by the Attorney-General of Ekiti State, Mr. Wale Fapounda who should take decisive measures to bring the criminals to book. Let no one politicize the criminality of those who are bent on replacing the rule of law with rule of force in Ekiti State. The Federal Government ought to distance itself from the shameless display of brute force by an in-coming governor. Ekiti State.
“In view of the duty imposed on the Nigerian Bar Association to defend the rule of law and protect judges and lawyers the leadership of the Bar in Ekiti State and at the national level should mount pressure on the Police Authorities to fish out those who beat up a judge, chased  judges and lawyers out of the Ekiti State High Court.
“Even under the defunct military junta judges were never subjected to physical assault over their decisions. Hence, in Garba v Federal Civil Service  Commision (1998) 1 NWLR (PT 70) 449 it was held by the Supreme Court (per Eso J.S.C.) that:
“the military in coming to power is usually faced with the question as to whether to establish a rule of law or rule of force. While the latter could be justifiable a rule of terror, once the path of law is chosen the mighty arm of government, the militia which is an embodiment of legislature and executive must in humility bow to the rule of law thus permitted to exist.
“The rule of law knows no fear, it is never cowed down, it can only be silenced. But once it is not silenced by the only arm that can silence it, it must be accepted in full confidence to be able to justify its existence”.

ZAZZAU EMIRATE COUNCIL MEMBER SHOT DEAD IN KADUNA

An influential chief and council member of the Zazzau Emirate,  Dokajin Cika Soron Zazzau, Kabiru Buhari, has been shot dead in Kaduna.
His car and body were found by a search team at his farm near Maigiginya in Nariya, Kabala West, Kaduna, on Friday around 4p.m. He had gunshot wound on his head.
He is survived by one wife and five children. He has since been buried in line with Islamic tradition.
The Cika Soron Zazzau and Hakimin Ungwan Muazu,  Ahmed Aliyu Idris, in an interview with journalists at the burial ground on Friday night, confirmed that the late chief was found dead in his farm on Friday.
“We closed from Council with him around 5p.m. on Thursday where I think he proceeded to his farm Maigiginya. His family later alerted us on Friday morning that he didn’t sleep at home. So, we reported to the police and commenced a search operation.
“His body was found inside his farm with his car parked around the farm round 3-4pm on Friday.
“We have left everything to God to judge whoever has hand in his death or any other innocent persons killed.”
The Emirate has recently come under several attacks among which are the recent killing of a petrol station manager and the murder of a lecturer with the Shehu Idris College of Health Technology.
On whether he is satisfied with the actions taken by the police to curtail the rampant killings in the area, Mr. Idris said, “Honestly I can’t say because I don’t think they are doing much to stop this killings in the society. They always say that they are searching for the killers.”
The Police Public Relations Officer in the state, Aminu Lawal, while confirming the incident, said the police took part in the search of Mr. Buhari and had since commenced investigation into the killing.

MASS DEFECTION THREATENS TO SCATTER OGUN APC.

There are strong indications that aggrieved members of the All Progressives Congress in the South-West, especially Ogun State, are set to dump the party next week.

Saturday PUNCH’s investigations showed that the planned defection would be led by former Governor Olusegun Osoba’s group in the APC.

It was gathered that the group, which had reached out to some APC members in the South-West, would join the Action Group of Nigeria, which it was learnt had applied for registration at the Independent National Electoral Commission.

The Chairman, Independent National Electoral Commission, Prof. Attahiru Jega, had in an interview with The PUNCH on Friday, said that eight parties had applied for registration.

Jega said that although the law did not make provision for the deadline on the registration of parties, INEC would bridge the gap administratively.

An APC chieftain, who spoke to Saturday PUNCH in confidence, said, “We have been waiting for the national leadership to resolve the crisis in Ogun State chapter. But with the release of the guidelines for primaries, it seems that the leaders have no regard for us.

“We have our plan; I can assure you that we are expecting INEC to register our party next week.”

When asked what the Osoba group would do, a leading member of the group, Senator Gbenga Kaka, told Saturday PUNCH to wait till next week.

Kaka said issues raised by members of the group had yet to be addressed by the APC leaders.

According to him, the issues have been left the way they were while the other group (Governor Ibikunle Amosun’s faction) has taken actions which have been inimical to the resolution of the crisis.

Kaka said, “To the best of my knowledge, the matter has not been resolved, except if a miracle is going to occur tomorrow.

“Without resolution or consultation with any of us, they (the APC) put forward their guidelines for the primaries.

“Since we cannot afford to betray our followers, we will decide a course of action for them.”

He was asked whether it was true that the faction was plotting to register a new political platform altogether as was being speculated.

Kaka answered, “You wait till next week. They said their primaries start by that time. The vulture is a patient bird.

“We want to give them the longest stretch. I advise you to wait till next week when we will come out with a definitive statement.”

Also, the Publicity Secretary of the APC faction loyal to Osoba, Mr. Clement Adeniji, said the faction had yet to reconcile with the Amosun group.

He said on the telephone, “The crisis has not been resolved, that I can confirm to you.”

Adeniji noted that the Matagbamole Group was disenchanted with the alleged injustice being meted to the leaders and those who worked for the party during the 2011 governorship election in the state.

But the Publicity Secretary of the APC, a faction loyal to Amosun, Sola Lawal said it was not true that the Ogun State chapter of the party issued the guidelines on primaries.

He said the issuance was done by the APC national body.

He said, “Issuance of guideline is beyond the capacity of any state chapter of the party.

“Therefore it will be unfair to hold such act against the party in Ogun State.

“I am sure Senator Kaka is old enough to appreciate the fact that the national organ of any party does not have to consult any group or subordinate chapter before carrying out its constitutional duties.”
